This Privacy Policy describes how Ethico Solutions Inc. and its subsidiaries and affiliates (“Social Nature”, “we”, “us” or “our”) collect, use, store, and share your information when (1) you access and/or use our websites, mobile applications, or other digital properties we own and operate, including www.socialnature.com (“Websites”); (2) you sign-up or register to become a Social Nature member and use our services (“Services”); (3) you communicate with us in any manner, including by email, direct or text messaging, telephone, and/or in person (“Communications”); and (4) we interact with certain third party partners and/or service providers. 

Please read this Privacy Policy carefully to understand our policies and practices regarding your personal information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services, Websites or Communications. By accessing or using our Services, Websites or Communications you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to our Privacy Policy). Your continued use of our Services, Websites or Communications after we make changes is deemed to be acceptance of those changes, so please check this Privacy Policy periodically for updates.

We do not knowingly collect, share, or sell personally identifiable information of anyone under the age of 16 and you should not provide us with any information regarding any individual under the age of 16. If we learn that we have inadvertently gathered information from anyone under the age of 16, we will take reasonable measures to promptly remove that information from our records.

We do not sell personal information or share personal information for cross-context behavioral advertising (also known as targeted advertising).

We retain personal information for the length of time needed to fulfill the purposes for collection unless a longer retention period is required or permitted by applicable law.

1. What Type of Information Do We Collect?

Depending on how you interact with our Websites and Services, the nature of our Communications, and how we may interact with certain third party partners or service providers, we may collect the following pieces of your information: 

1. Basic Identifying Information. Information you provide when you sign-up or register for an account for our Services such as your full name, profile photograph, postal address, e-mail address, phone number, account name, username, and other similar identifiers.

2. Device Identifier and other Unique Identifiers. Information such as your device identifier, internet protocol (IP) address, cookies, beacons, pixel tags, mobile ad identifier, and other unique identifiers.

3. Internet or Other Network Activity. Information such as your browsing or search history, and other information regarding your interactions with our Websites, emails, and advertisements.

4. reCAPTCHA. We may use reCAPTCHA. reCAPTCHA is a third-party software that collects information about users for security and fraud detection purposes. Information collected through the use of reCAPTCHA is held in accordance with the Google Privacy Policy, located at https://www.google.com/policies/privacy/.

5. Geolocation Data. Information such as your zip code that permits us to determine your location so that we can determine the best place for you to pick up products and samples.

6. Commercial and Purchase Information.Information such as the products and samples you have purchased and considered, your preferences on various products and brands, photographs of your receipts containing purchases, and related information about your commercial activities.

7. If you are making purchases in the State of Washington (WA), we may collect Consumer Health Data, as that term is defined by WA law, when you submit your receipt containing purchase information to us. 8. Demographic Information.Information such as your age, gender, and date of birth.

9. User Content.Information such as your Communications with us and any other content you provide, such as social media profiles, photographs of receipts, images, videos, survey responses, comments, product reviews, testimonials, and other content.

10. Audio and Visual Information.Information such as photographs, images, videos, and recordings of your voice (such as when you leave us a voicemail).

11. Inferences.Information such as inferences drawn from or created based on the information identified above.

2. How Do We Collect Your Information?

We may receive and collect your information in the following ways: (i) directly from you when you use our Websites, Services, and Communicate with us; (ii) automatically using online technologies when you engage with our Websites, Services, and Communications; and/or (iii) from our third-party partners or service providers.

1. Directly from you. We collect information directly from you when you: (i) enter your information on our Websites, (ii) create an account or profile, sign up or register for our Services, (iii) update your profile, access our content, or participate in our rebate programs, (iv) take a survey or a poll or enter a contest, (v) use our Websites or Services, (vi) engage in Communications with us, and/or (vii) sign-up to receive emails, text messages, or certain other Communications from us.

2. Automatically Using Online Technologies. When you visit our Websites, open or click on emails we send you or related Communications, or interact with our advertisements, we or other third parties may automatically collect certain information about you using online tracking technologies such as cookies, pixels, web beacons, software developer kits, and related technologies. 3. From Our Partners and Service Providers. We collect information from our third-party partners or service providers, such as brands, data analytics providers, marketing or advertising providers, fraud prevention service providers, and vendors that provide services.

4. From Social Media Platforms and Networks. If you interact with us on or through social media, or use features or sign-in to your account using social media plugins, widgets, or other tools made available by social media platforms or networks (e.g., Instagram, Facebook, Twitter, Google, or YouTube) in connection with our Websites and Services, we collect information that you disclose to us, or that the social media platform discloses to us.

5. Reviews and Testimonials. We may use and publicly display on our Websites or Services any product or service reviews or ratings you provide to us or any third parties (“Your Reviews”). You alone are responsible for Your Reviews, and once published or otherwise used by us in accordance with this Privacy Policy Your Reviews cannot always be withdrawn. You assume all risks associated with Your Reviews, including anyone's reliance on their quality, accuracy, or reliability, or any disclosure by you of information in Your Reviews that makes you personally identifiable.

3. Cookies and Other Online Tracking Technologies

We and third parties may use cookies, pixels, web beacons, software development kits, and other similar online tracking technologies to gather information about you when you use our Websites, interact with some of our Services, and engage with our Communications.

1. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Websites, Services or Communications. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Websites.

2. Pages of our Websites and our Communications may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

These online tracking technologies may be used to maintain the security of our Websites, manage your account, prevent crashes, fix bugs, save your preferences, assist with basic Website functions, advertising, analytics, and other performance functions. We may use cookies to track your interactions with our Services and Websites, including when you have not completed an action on the Websites or abandoned your sign up or registration process, and this information is used to determine when to send reminder messages via the Websites, SMS (text messaging) or email.

Our Websites use Google Analytics for analytics purposes. To opt out of Google Analytics Advertising Features please use  Google Ad Settings. To opt out of Google Analytics entirely please use this link. We may also use the Google Maps service, and other services on our Websites, to collect geolocation data. 4. How Do We Use Your Information?

We use your information for a variety of purposes, including:

1. To Provide our Websites and Services to You. We use your information to provide our Websites and Services to you, including to: (i) create and manage your account when you sign-up or register to use our Services; (ii) facilitate your access and use of our Websites; (iii) process your receipts and feedback on products to facilitate your participation in the Services, including but not limited to certain rebate and rewards programs; (iv) send you notifications relating to your account and participation in our Services; (v) answer your Communications; and (vi) perform other related business functions.

2. To Communicate with You. We use your information to engage in Communications with you, such as to respond to your requests, inquiries, issues, feedback, and to provide customer service.

3. To Market and Advertise. We use your information for marketing and advertising purposes, including sending marketing, advertising, and promotional communications to you by email, text message, or postal mail. We also use your information to show you advertisements for Services and to administer our sweepstakes and other contests.

4. For SMS / Email Marketing and Support. We may use your personal information to send you emails or text notifications for your registration or membership, promotions, text or email marketing offers, transactional texts, or requests for reviews. Opt-in data and consent for text messaging will not be shared with any third parties except for messaging partners, for the purpose of enabling and operating our text messaging program.

5. To Conduct Analytics and Personalization. We use your information to conduct research and analytics, including to improve our Websites and Services. We also use your information to understand your interaction with our Websites, advertisements, Services, and our Communications with you. We also use your information to personalize your experience, to save you time when you visit our Websites and use our Services, to better understand your needs, and to provide personalized recommendations for our Services.

6. For Security and Fraud Prevention. We use your information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions. We also use your information to enforce our terms and conditions (including our Terms of Service) and procedures, prevent against security incidents, and prevent the harm to other users of our Services.

7. For Legal Obligations. We use your information to comply with our legal and regulatory obligations, to establish and exercise our rights, and to defend against legal claims.

8. For Business Functions. We use your information to support our core business functions, including to maintain records related to business management, loss prevention, collecting amounts owed, and identifying and repairing errors or problems in the Websites.

9. To fulfill any other purpose for which you provide it. For example, if you share your name and contact information to request information or ask a question about our products or services, we will use that personal information to respond to your inquiry.

10. To Comply with a request from you in connection with the exercise of your rights. For example, where you have asked us not to contact you for marketing purposes, we or our service providers will keep a record of this on our suppression lists to be able to comply with your request.

11. For Other Purposes. We may also use your information in other ways. To the extent required by applicable law, we will provide notice at the time of collection and obtain your consent.

In addition to the foregoing, we may aggregate or anonymize information in de-identified or aggregated form and use it for any purpose.

5. How Do We Disclose Your Information?

We may disclose or share your information with affiliated and non-affiliated third-parties, including in the following scenarios:

1. With your Consent. We may disclose or share your information if you direct us to do so or with your consent, which may be obtained in writing, online, including through “click-through” agreements, when you accept the terms of use on our Websites, orally, either in person or on the phone, or by other means.

2. In a Business Transfer. We may disclose, share, lease, sell, assign, or transfer the information we collect (including your information) to third parties in connection with a Business Transfer. A “Business Transfer” means a sale, acquisition, merger, consolidation, reorganization, bankruptcy, or other corporate change involving us, even if the Business Transfer is only being contemplated and regardless of whether the Business Transfer relates to a part of or our whole business. Nothing in this Privacy Policy is intended to interfere with our ability to transfer all or part of our business, equity, or assets (including our Websites and Services) to an affiliate or independent third party at any time, for any lawful purpose, without notice or compensation to you.

3. To Non-Affiliated Third Parties. We may disclose or share your information with certain non-affiliated third parties (such as third-party service providers, vendors or suppliers) to facilitate your access and use of our Websites, our Services, Communications, and to provide us with certain business functions, including, but not limited to, sharing your information with brand partners, internet service providers, advertising networks, data analytics providers, governmental entities, operating systems and platforms, social medial networks, payment or rebate processors (which is currently Tremendous) and service providers who provide us a service (e.g., customer service, auditing, marketing, messaging, debugging to identify and repair errors that impair existing intended functionality on our Websites, and/or protecting against malicious, deceptive, fraudulent, or illegal activity). We allow third party partners to use and display some of the public content available through our Services and Websites, such as Your Reviews, photos, and other information that you publicly display on our Websites or Services.

4. To our Brand Partners and Clients. We may share your personal information with our brand partners and clients. For example, when you participate in our rebate program, we will disclose the information you provide to our clients or brand partners. Please note that, while we contractually require our brand partners and clients to keep personal information confidential and use it only for the purposes for which we disclose it to them, once we share your personal information with another company in the above circumstances, the information received by the other company is controlled by that company and becomes subject to the other company's privacy practices.

5. To our Affiliates. We may disclose or share the information we collect, including your information, to our affiliates and their respective employees, agents and representatives involved in delivering our Websites, Services, Communications, products and other services to you.

6. To Social Media Platforms and Networks. Some of our Websites and Services have features such as plugins, widgets, and/or tools made available by social media platforms to access or interact with our Websites and Services that may result in information being disclosed by us to those social media networks, including but not limited to Facebook, Twitter or Pinterest.

7. For Legal Process and Protection. We may disclose or share your information to satisfy any law, regulation, legal process, or governmental request (including in connection with claims, disputes, or litigation), or where we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to: (i) enforce or apply our agreements; (ii) protect our interests, property, or safety of others; or (iii) protect our Websites, Services and Communications.

8. Aggregation and De-Personalization. We may use and disclose any de-identified information for any lawful purpose, including for any commercial purpose. De-identified Information means information that does not identify you, including any identifiable information de-identified by either combining it with information about others, for example, by aggregating your information with information about other persons, or by removing characteristics, such as your name, that make the information personally identifiable to you.

9. Other Purposes. We may disclose or share the information we collect, including your information: (i) to fulfill the purpose for which you provide it (For example, if you give us an email address to use the “invite / refer a friend” feature of our Websites, we will transmit the contents of that email and your email address to the recipients or if you opt-in to receive newsletters or promotions from our brand partners, we will share your name and email address with the brand partner for such purpose.), (ii) to any person who, in our reasonable judgment, is authorized to receive your information as your agent, including as a result of your business dealings with that person (for example, your attorney), (iii) if requested by authorities in the event of any act or instance of local, regional or national emergency, or (iv) to otherwise enforce or protect our rights.

Please note that the list above is not exhaustive and that we may, to the extent permitted by applicable law, disclose the information we collect to third parties at any time, for any lawful purpose, without notice or compensation to you. 

When we disclose the information we collect to third parties, such information will become permanently subject to the information use and sharing practices of the third party, and the third party will not be restricted by this Privacy Policy with respect to its use and further sharing of such information. Furthermore, these third parties may further disclose, share and use this information. By submitting information (including your information) to us, you expressly consent to such disclosure and use of such information. If you do not want this information (including your information) shared as described above, then you should not provide us with such information.

6. How Do We Protect Your Information?

We use certain technical, administrative, and organizational security measures to keep your information safe. However, despite our efforts, please be aware that methods of transmission and electronic storage are not completely secure. We cannot guarantee the privacy or security of your information, as third parties may unlawfully intercept or access transmissions or electronic storage. Further, to the extent permitted by law, we are not responsible for circumvention of any privacy settings or security measures of our Services, Websites or Communications. Therefore, you use our Services, Websites and Communications at your own risk, you should not expect that your information will always remain private, and we do not guarantee the performance or adequacy of our security measures. In the event that an unauthorized third party compromises our security measures, to the extent permitted by law, we will not be responsible for any damages, directly or indirectly, caused by an unauthorized third party’s ability to view, use or disseminate your information.

7. How Long Do We Keep Your Information?

We keep your information for as long as is necessary in accordance with the purpose for which it was collected, our business needs, and our legal and regulatory obligations. If we dispose of your information, we will do so in a way that is secure and appropriate to the nature of the information subject to disposal.

8. Accessing and Correcting Your Information

You can review and change your personal information by logging into our Services (e.g., visiting your account / profile page) or you may visit the Data Subject Access Request Form to delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

9. Links To Third Party Sites and Information That You Disclose to Third Parties

Our Websites and Services may contain links to third party websites and services, including to social media networks such as Facebook, Twitter or Pinterest. Please note that these links are provided for your convenience and information, and the websites and services may operate independently from us and have their own privacy policies or notices, which we strongly suggest you review. Our Services and Websites, including any of our Communications, may contain links or access to websites or platforms operated by third parties that are beyond our control. Links or access to third parties from our Services, Websites, or Communications is not an endorsement by us of such third parties, or their respective websites, applications, products, platforms, or practices. We are not responsible for the privacy policies, terms and conditions, practices, or the content of such third parties. All information that you disclose to such third parties will be subject to the privacy policies and practices of such third parties. You should review the privacy policies and practices of such third parties prior to disclosing information to them. If you have any questions about how these third parties use your information, you should review their policies and contact them directly.

10. Do Not Track

Our Websites may, from time to time, collect information about your online activities, over time and across our different websites. When you use our Websites, third parties may also collect information about your online activities, over time and across different internet websites, online or cloud computing services, online applications, or mobile applications. Some browsers support a “Do Not Track” (“DNT”) feature, which is intended to be a signal to websites that you do not wish to be tracked across different websites you visit. Since uniform standards for “DNT” signals have not been adopted, our Services and Websites do not currently process or respond to “DNT” signals or change the way they operate based upon detection of a “Do Not Track” or similar signal.

We strive to provide you with choices regarding our collection, use and disclosure of the information that we collect. Below are some mechanisms that provide you with control over such collection, use or disclosure:

1. Cookies and Other Tracking Technologies. It may be possible to disable some (but not all) cookies or automatic data collection technologies through your device or browser settings, but doing so may affect the functionality of our Services and Websites. The method for disabling cookies or other automatic collection technologies may vary by device and browser, but can usually be found in preferences or security settings. You can exercise your preferences in relation to cookies served on our Websites or Services by taking the steps outlined below.

   1. First-Party Cookies. You can use the browser with which you are viewing our Websites or Services to enable, disable or delete cookies. 2. Manage Communication Preferences. You can stop receiving promotional or marketing e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail you receive from us. If you opt-out from receiving our promotional or marketing e-mails, you may continue to receive certain status e-mails relating to your transactions on or through our Services or Websites. 3. Correct Your Information. Social Nature members are able to change their information at any time by logging into our Services (e.g., visiting your account / profile page) or you may visit the Data Subject Access Request Form to or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

4. Location Information. You can disable location-based services on your mobile device or web browser by adjusting the settings on your device or browser. This will prevent our Websites and Services from accessing your location information. Note that some Services may not be available if you disable location-based services.

5. Social Media. This Privacy Policy does not cover the privacy and security practices of social media platforms on which we have social media pages. Please review the terms, policies, and settings of those social media platforms if you have questions about how they collect and use your data and information.

6. Global Privacy Control. 12. YOUR STATE PRIVACY RIGHTS

This section supplements the information contained in this Privacy Policy and is relevant only to residents of certain U.S. states that have their own data privacy laws and regulations. Please note that the state specific rights set out below apply only to users who reside in the applicable state jurisdiction AND if we, as an organization, meet the jurisdictional threshold(s) in the applicable state jurisdiction.

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

Nevada law permits our users who are Nevada consumers to request that their personal data (as defined under applicable Nevada law) not be sold, even if their personal data is not currently being sold. Requests may be made by visiting the Data Subject Access Request Form.

Notice of Use of Sensitive Personal Information
We may collect certain sensitive personal information (purchases that may be related to a user’s health or sex life if the receipt or transaction information includes such purchases). 13. California Privacy Notice

This section supplements the information contained in this Privacy Policy, but applies solely to all visitors, users, and others who reside in the State of California (for purposes of this section only, “consumers” or “you”). We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided.

Exercising Your Access, Data Portability, and Deletion Rights:
How to Exercise. To exercise the access, data portability, and deletion rights described above, you may visit the Data Subject Access Request Form or call us toll-free at 1-877-490-0808. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

General Requirements. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. It must also describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format. We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please email us at legal@socialnature.com with the subject line: California Privacy Protection. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. If you have an account with us, we may deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

14. Washington State Consumer Health Privacy Policy

The State of Washington imposes certain limitations and restrictions on businesses that collect Consumer Health Data of Washington residents or individuals purchasing products in the State of Washington.

Categories of Consumer Health Data Collected: As defined under the Washington My Health My Data Act, the term “Consumer Health Data” is defined broadly and could apply to certain data that we collect from you. This includes personal information that can be linked to you that identifies a past, present, or future physical or mental health status. In many instances we are unable to control whether we receive your Consumer Health Data, as you are responsible for controlling what purchase data (including a photograph of your receipt that contains products you purchased) you submit to us.

Categories of Consumer Health Data that we may collect include:

1. Purchase information related to your health conditions, symptoms, status, diagnoses, or treatments. For example, you may submit a receipt which contains purchase information to us that includes over-the-counter medications.

IF YOU DO NOT WANT US TO COLLECT YOUR CONSUMER HEALTH DATA, THEN YOU SHOULD NOT SUBMIT RECEIPTS TO US THAT CONTAIN YOUR CONSUMER HEALTH DATA. BY SUBMITTING SUCH INFORMATION TO US, YOU CONSENT TO OUR COLLECTION OF YOUR CONSUMER HEALTH DATA FOR THE PURPOSES DESCRIBED IN THIS PRIVACY POLICY.

Categories of Sources from which Health Data is Collected: As further described in this Privacy Policy, we collect Consumer Health Data directly from you and through your interactions with our Websites and Services and your Communications with us.

The Purpose and Intended Use for Collected Health Data: We use personal information (including Consumer Health Data) for the purposes set forth in the How Do We Use Your Information? section above.

Categories of Health Data Shared: As defined under Washington law, we do not share Consumer Health Data.

Categories of Third Parties and Affiliates that Receive Health Data of WA Residents: We may disclose Consumer Health Data to processors as necessary to provide consumers with our services in a manner consistent with the purpose for which the Consumer Health Data was collected. For example, we may disclose Consumer Health Data to processors in order to validate purchases and offer you a rebate, reward or redemption. Rights Under WA Law and How to Exercise Them: You have certain rights under WA law regarding how we collect, process, and share your Consumer Health Data.

1. Right To Withdraw Consent to The Collection of Your Consumer Health Data: As described above, Washington law defines Consumer Health Data broadly. Certain information that you submit to us may be considered Consumer Health Data. If you do not wish for us to collect your Consumer Health Data, then you should make certain that you do not submit purchase information to us that identifies or that could lead us to infer a past, present, or future physical or mental health status.

Right To Have Your Consumer Health Data Deleted: You may request that we delete all of the personal information (including your Consumer Health Data) we have collected from you in the past, subject to certain limited exceptions. Our Websites, Services and Communications are not intended for individuals under the age of 18. This includes any links to other websites that we provide for our convenience. We don’t knowingly collect the information of individuals under the age of 18.
